HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.10209 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the Government Pleader for the Civil Supplies for the State of Andhra Pradesh.
2. This writ petition is filed seeking writ of Mandamus declaring the action of the 2nd respondent in suspending the authorization of the petitioner fair price shop No.13, situated at Marutla-I Village, Kadiri Mandal, Ananthapuramu District, vide proceedings dated 03.03.2015, as illegal and arbitrary.
3. The authorisation of the petitioner was suspended by order dated 03.03.2015 by the 2nd respondent on the ground that the petitioner possessed 31 bogus cards and maintained Key Register showing that the commodities have been issued to the said 31 bogus card holders. The same has been noticed by the Civil Supplies Deputy Tahsildar and he sent a report to the Revenue Divisional Officer-2nd Respondent, basing on which the suspension order was passed. In any event, the allegations levelled against the petitioner are serious in nature, which require an enquiry by the appointing authority.
4. Therefore, the writ petition is disposed of directing the 2nd respondent-Revenue Divisional Officer, Kadiri, Ananthapuramu District to conduct enquiry against the petitioner and pass final orders within a period of two (2) months from the date of receipt of a copy of this order. Miscellaneous applications, if any, shall stand closed. No order as to costs.
