HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.9186 of 2017 ORDER :

Heard the learned counsel for the petitioner/ A.1 in Cr.No.119 of 2017 on the file of the SHO, Saroornagar Woman Police Station, registered for the offences punishable u/ sec.498-A and 506 of IPC and u/ sec.4 of the Dowry Prohibition Act r/ w Sections 3(1)(s) of the Scheduled Castes and Scheduled Tribes(Prevention of Atrocities) Act (for short, 'the Act'), and also the learned Public Prosecutor for the 1st respondent-State before ordering notice to the 2nd respondentcomplainant and perused the contents of the FIR and grounds urged in the quash petition.

Apart from the fact that there is no public view to attract Section 3(1)(s) of the Act, once it is a love marriage known and the wife and husband lived for some time happily, the attracting of very offence u/ sec.3 of the Act itself is bleak as rightly contended by the learned counsel for the petitioner despite opposed by the learned Public Prosecutor of such contention.

Having regard to the above and in the result, the Criminal Petition is disposed of as there is nothing to interdict the investigation but pending investigation the petitioner shall not be arrested however, it will not prevent the police to secure presence of the petitioner for the purpose of investigation if necessary.
