HON'BLE SRI JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT APPEAL No. 401 OF 2007 JUDGMENT: (per the Hon'ble Sri Justice Dilip B. Bhosale) None appears for the appellants. Heard learned counsel for the respondent. We have perused the order dated 12-04-2007 in Rev.WPMP No.9337 of 2007 in WPMP No.3796 of 2007 in Writ Petition No.2966 of 2007 and we find that this writ appeal can be conveniently disposed of even in the absence of the appellants.
Review petition was filed by the appellants seeking review of the order dated 15-02-2007 passed in WPMP No.3796 of 2007 in Writ Petition No.2966 of 2007. By that order, the learned Judge while admitting the writ petition had granted interim suspension of the order of dismissal vide memo dated 04-02-2007. This Court while admitting the writ appeal on 09-05-2007, had granted stay of the order passed by the learned single Judge on WAMP No. 758 of 2007. The interim order is running since then till now. In view thereof, when we expressed that this writ appeal deserves to be disposed of with a request to learned Judge to dispose of the writ petition itself at the earliest, learned counsel for the respondent fairly agreed for the following order: "The interim order passed by this Court on 09-05-2007 on WAMP No.
758 of 2007 shall remain operative till disposal of Writ Petition No.2966 of 2007. It is made clear that while passing this order, we have not examined merits of the case. The learned Judge, who is assigned to hear writ petitions, is requested to decide the writ petition expeditiously."
With these observations, the writ appeal is disposed of. Miscellaneous petitions, if any, also stand disposed of. There shall be no order as to costs.
