ORDER
The petitioner-accused filed the present application under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to grant bail to them in Crime No.88 of 2026 of Mangalhat Police Station, Kulsumpura Division, Hyderabad, registered for the offences punishable under Section 103(1) read with 3(5) of the Bharatiya Nyaya Sanhitha, 2023.

The brief facts of the case are that on 25.02.2026, the accused persons beaten the deceased over a petty quarrel which
took place between them while consuming alcohol and that the deceased succumbed to death. Hence, a case was registered against the petitioners.

Heard Mr.V.Surender Rao, learned counsel appearing on behalf of the petitioners as well as Mr.Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submit that accused No.2 with similar allegations in the same crime has been granted bail by the Court on 27.04.2026 in Criminal Petition No.5707 of 2026 on the ground that the alleged offence took place in a sudden altercation and there are no previous disputes between accused No.2 and the deceased. Therefore, he prayed the Court to grant bail to the petitioners by allowing this Criminal Petition. 5.
Learned Additional Public Prosecutor submits that accused No.2 was already granted bail by this Court.

In the light of the submissions made by both the learned counsel and on perusal of the material available on record, it appears that the accused No.2 with similar allegations in the same
crime has already been granted bail by this Court on 27.04.2026 in Criminal Petition No.5707 of 2026. Considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioners/accused subject to the following conditions: (i) Each petitioner shall execute a personal bond for Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of the XVI Additional Chief Judicial Magistrate, Hyderabad.
(ii) The petitioners shall abide by the other conditions stipulated in Section 480(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
(iii) The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m., and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
