2017-06-12S.V.Bhatt2 pages

HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.18744 of 2017 ORDER:

Though the prayer is one against inaction, this court is not inclined to exercise its discretion or jurisdiction and issue directions to the respondents to look into the representation dated 16.02.2017. The representation was made on 16.02.2017 and the petitioners ought not to entertain the idea that the entire administration should go after his representation and decide expeditiously. Always little breathing time should be given to the authorities. There should be demand and refusal and if inaction continues then a suitable prayer can be made for consideration by this court.

At this stage, learned counsel for the petitioners seeks leave of the court to permit the petitioners to withdraw the writ petition for the present by giving liberty if the inaction is continued even after some time to file a fresh writ petition.

The writ petition is, accordingly, dismissed as withdrawn by granting liberty as prayed for. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
