Heard the learned counsel for the petitioners, learned Government Pleader for Higher Education, appearing for 1st respondent and Sri S.Anand, learned counsel for 2nd respondent.

Petitioners' grievance is that petitioners were not afforded an opportunity of personal hearing by 2nd respondent for the fixation of fee for the courses being taught in the 2nd petitioner's institutions for the block period 2016-17 to 2018-19 since the petitioners inadvertently failed to press the freeze button after uploading the data online and submit hard copies of the same to the 2nd respondent.

Learned counsel for the petitioners relies on order dt.04-04-2016 in W.A.No.201 of 2016, wherein, in a similar case, this Court permitted the appellant No.2 to furnish a proposal within ten days from that date to 2nd respondent for fixation of fee for the said block period and gave certain other directions.

4. This is not disputed by the learned Standing Counsel for the 2nd respondent.

In view of the same, the Writ Petition is disposed of directing the petitioners to furnish their proposal within a period of ten days from today to 2nd respondent for fixation of fee for the block period 2016-17 to 2018-19. If the petitioners furnish the proposal, as aforementioned, to the 2nd respondent, he shall consider the same on merits, in accordance with law, within a period of six weeks from the date of its presentation. It is needless to mention that the petitioners shall cooperate for considering and deciding their proposal within the stipulated time. Further, it is needless to mention that the petitioners shall pay necessary process fee and any other charges which may be demanded by the 2nd respondent for late submission of the fee proposal for the block period 2016-17 to 2018-19, within three days from the date of such demand.

6. In view of this order, the order dt.24-02-2016 passed in Writ Petition No.3896 of 2016 renders ineffective. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
