Alleging that petitioner deviated from the building permission granted to him on 06-04-2018, a notice under Section 452(1) and 461(1) of HMC Act was issued on 16-08-2019. Apparently, petitioner has not submitted her explanation to the said notice. It is alleged that petitioner encroached two feet of Seri Sandhi and deviated sanctioned plan by constructing stilt floor, which is actually meant for parking. It is, therefore, for the petitioner to explain whether she has deviated as alleged. It cannot be said that show-cause notice is issued by incompetent authority or show-cause notice is without jurisdiction. Whenever the authority finds that there is deviation from the sanctioned plan or illegal construction is made, authorities are competent to issue notice.

Thus, this Court is not inclined to entertain the writ petition against show-cause notice. However, since time granted by respondent expired, petitioner is granted seven (07) more days from today to file her explanation to the show-cause notice. Till the explanation is considered and appropriate decision is made, respondents are directed not to take coercive action against the petitioner.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. __________________ P.NAVEEN RAO,J 23-08-2019 Nvl
