HONOURABLE JUSTICE G. SRI DEVI CRIMINAL REVISION CASE NO.1800 OF 2017 ORDER:
The petitioners/accused and the respondent-complainant are present and they are duly identified by their respective counsel. A memorandum of compromise has been filed stating therein that the petitioners/accused and the respondent-complainant have compromised their disputes after negotiations. A final meeting was held in the Zonal Office of the complainant, wherein it was mutually agreed that the accused persons have paid the disputed cheque amount of Rs.20,00,000/- to the complainant and the complainant has received the same. It is further submitted that all the disputes pending between the petitioners/accused and the respondent/complainant are compounded as per the terms and conditions and accordingly, the complainant has agreed that he received the amounts and agreed to issue 'no due' certificate towards full and final settlement.
It is further submitted that the complainant has also agreed to withdraw the present case as he has received the amount due and he has no objection if the petitioners are discharged from this case. Both the parties have also agreed to withdraw all the cases pending against each other. Thus, in view of the compromise entered into between the parties, the petitioners seek indulgence of this Court to compound the present case by recording the compromise and to dispose of the present Criminal Revision Case pending before this Court. In the light of the order passed by this Court on 05.02.
offence under Section 138 of the Negotiable Instruments Act is compounded.
Accordingly, the Criminal R.C. is allowed in terms of compromise, and the judgments passed in Crl.A.No.763 of 2016 dated 08.06.2017 by the Special Judge for Trial of Offences Under SCs & STs (POA) Act-cum-VI Additional Metropolitan Sessions Judge, Secunderabad and in C.C.No.180 of 2015 (Old C.C.No.743 of 2015) dated 11.08.2016 on the file of the XI Special Magistrate, Secunderabad at Hyderabad, are hereby set aside. Miscellaneous applications, if any, pending, shall stand closed.
