HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9617 of 2017 ORDER :

This Criminal Petition is filed under Section 482 Cr.P.C. by petitioner/ accused, seeking to quash the proceedings in Crime No.148 of 2017 on the file of the B.K.Samudram Police Station, Ananthapuramu District, registered for the offences punishable under Sections 498-A and 324 I.P.C. and Section 4 of the Dowry Prohibition Act.

Heard the learned counsel for the petitioner and learned Public Prosecutor representing the State before ordering notice to the 2nd respondent and perused the contents of F.I.R. and grounds urged in the quash petition.

It is the main contention of the learned counsel for the petitioner that four days after the alleged incident, it is with engineered version, a false case is foisted against the petitioner/ accused, taking advantage of the differences between the couple and the earlier case pending before the Court including alleged incident happened near the Court, in a private premises.

A perusal of the material on record shows that there is nothing to interdict the investigation, but for, to say pending investigation, the petitioner/ accused shall not be arrested.

However, it will not prevent the Police to secure the petitioner for the purpose of investigation, as and when required. Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
