THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.6795 OF 2015 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioner-A.2 seeking to quash the proceedings in C.C. No.871 of 2014 on the file of the XI Additional Chief Metropolitan Magistrate, Secunderabad registered for the offences punishable under Sections 467, 406, 420, 465, 477A, 201, 109 and 120B IPC.

Heard the learned counsel for respondent No.2 and the Assistant Public Prosecutor appearing for respondent No.1-State. Sri V.Venkata Ramana Reddy, Advocate representing the counsel for petitioner reports not ready and requests the Court to adjourn the case to some other day.

As per the submissions made and the material produced on behalf of respondent No.2, this Court has dealt with the subject matter of this Criminal Petition in earlier Criminal Petition No.10145 of 2014 which was filed seeking to quash the same proceedings, and by way of order dated 09.10.2014 wherein the Criminal Petition was disposed of giving liberty to the petitioner to file an application under Section 239 Cr.P.C. for discharge. Aggrieved by the said order, the petitioner-A.2 did not seek any appropriate remedy before the competent Court. Again, he has come up with this petition to quash the same proceedings. The lis has already been agitated before this Court in the earlier Criminal Petition. In the absence of any change of circumstances, it is not permissible under law. It is not appropriate for petitioner-A.2 to file petition after petition for similar reliefs before this Court.
Therefore, it is not appropriate to keep this Criminal Petition pending. In view of the circumstances stated supra, the Criminal Petition is dismissed.
Miscellaneous Petitions pending, if any, in the Criminal Petition shall stand closed.
