2017-10-11A.Rajasheker Reddy4 pages

HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No. 33610 And WP.No.33830 of 2017 COMMON ORDER:

The grievance of the petitioners is that since the respondent-company has issued notification dated 05/2017 in September, 2017 for filling-up posts of various executive and non-executive cader posts including the post of Electrician Trainee, Cat.I (Men only) and the maximum age prescribed in the notification is 30 years as on 01-09-2017. But the petitioners are over aged and seek a direction to consider their cases on the ground that for the last ten years the respondentcompany has not issued any notification. As the relief sought for by the petitioners is one and the same, these writ petitions are being disposed of by common order.

Learned Standing Counsel for respondent-Company produced notifications issued in the year 2015 and states that notifications were issued in the year 2010, 2013 and 2015. Learned counsel for the petitioners also brought to my notice the G.O.Ms.No.190, General Administration (Services-A) Department, dated 08-08-2017, wherein the Government of Telangana enhanced maximum age limit from 34 to 44 years and it applies to direct recruitment by TSPSC and other recruitment agencies. As such, the petitioners are also entitled for the benefit of said G.O.

Learned Standing counsel says that unless Board of Directors takes decision, the same is not applicable to the respondent-Company.

In view of the fact that earlier notifications have been issued and the respondent-Company has not taken any decision to extend the benefit given in the said G.O., this Court is unable to issue any direction. However, this will not prevent the respondent-Company from taking a decision in extending the benefit in the G.O. Ms.No.190, dated 08-08-2017. Subject to above observations, these writ petitions are disposed of. As a sequel to the disposal of these petitions, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 11-10-2017 Nvl
