HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5500 of 2019 ORDER :
This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the proceedings in CC No.466 of 2018 on the file of XX Metropolitan Magistrate, Malkajgiri at Kodad. 2.
The 2nd respondent herein filed a complaint against the petitioner herein for the offence punishable under Section 138 and 142 of the Negotiable Instruments Act, 1881. 3.
Though the present Criminal Petition is filed seeking quashing of entire proceedings against the petitioner, learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of the petitioner is not in dispute, his presence in the above CC may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioner-accused in CC No.466 of 2018 on the file of XX Metropolitan Magistrate, Malkajgiri at Kodad, is hereby dispensed with while permitting him to mark his appearance through his counsel, except on the dates when his presence is specifically required by the said Court.

With the above direction, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
