This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.1 in Crime No.74 of 2026 of Chityal Police Station, Nalgonda District, registered for the offences punishable under Sections 118(2), 115(2), 352 and 351 (2) of Bharatiya Nyaya Sanhitha, 2023.

The brief facts of the case are that on 19.03.2026 at about 09.00 PM,while the complainant and his family were passing through the bazaar at Vembavi Village, the petitioner/accused No.1 allegedly abuse them in filthy language, threatened them regarding entry into a temple, and attacked the complainant with a knife causing injury. Other accused also allegedly joined, assaulted the complainant and his son with a stone and stick, and criminally intimidated them. Hence, action was sought against the accused. 3.
Heard Mr.Prakash Yarra, learned Counsel appearing on behalf of the petitioner as well as Mr.Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent No.1-State.

Learned counsel for the petitioner submits that the petitioner is accused No.1 in Crime No.74 of 2026 and further submits that there was an altercation between the petitoner and his family members and also family members of the complainant and it was the petitioner's son, who got injured in the altercation, but complainant has given the complaint
against the petitioner and petitioner also given the complaint against the complainant which is registered as Crime No.75 of 2026. They have also drawn attention of this Court that that the photographs and medical certificate, whereunder, it is mentioned that one Srikanth has received injuries and it has been considered. It is submitted that Srikanth is son of the petitioner. Initially, the case was registered under 118(1) and subsequently altered to 118(2) and in support of his contentions said alteration is made and sustained in regard to the decision of this Court in Crl.P.No.5788 of 2025 dated 30.04.025. Therefore, he prayed for grant of pre-arrest bail by allowing the Criminal Petition.

On the other hand, learned Public Prosecutor opposed the grant of bail and granting of pre-arrest bail to the petitioners does not arise. Hence, he prayed the Court to dismiss the criminal petition.

Having gone through the material, and since there is a case of altercation and both the family members have filed a case and counter case against each other and the petitioner's
son also appears to have been injured, this Court is inclined to grant pre-arrest bail to the petitioner/accused No.1, subject to the following conditions:
i.
The petitioner-accused No.1 shall surrender before the Station House Officer, Chityal Police Station, Nalgonda District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer, as and when required.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending, shall stand closed.
