HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.20303 of 2017 ORDER:

Heard learned counsel for the petitioner and also the learned Government Pleader for Panchayat Raj representing respondents 1 to 3 and 5 and Sri G.Narender Reddy, learned standing counsel, who offers to file vakalat on behalf of 4th respondent, and perused the prayer in the writ petition with the supporting affidavit.

2) The grievance of the petitioner is that having accorded permission to install the statue of Komaram Bheem in the panchayat limits near Nandipet-Armoor Bye-pass road, Nandipet, all of a sudden, the 4th respondent has directed to remove the statue under construction, which is illegal.

3) It is the submission of learned Government Pleader for Panchayat Raj that the notice issued is for violation of the provisions and it is the submission of learned standing counsel for the Panchayat that the resolution was passed to construct the statute by following the provisions of law and the rules and if there is violation of provisions, the respondents are entitled to ask for demolition else demolish.

4) It is the submission of the petitioner that there is no opportunity in issuing the impugned notice dated 06.06.2017 for demolition.

5) Having regard to the above, the writ petition is disposed of directing the respondents to maintain the existing status quo, which was passed by this Court on 23.06.2017, for two months from today and the petitioner shall file his reply to the show

Dr. SSRB,J WP_20303_2017 cause notice within one week from today and the respondents will pass appropriate orders within one month therefrom and any further grievance of the petitioner, if at all aggrieved is left open.

6) Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
