THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.648 of 2015 ORDER :

This contempt case is filed alleging that the order passed by this Court in W.P.No.15498 of 2014 dated 06.06.2014 is violated by the respondentCantonment Board.

2. This Court directed consideration of explanation submitted by the petitioner-Companies on 14.02.2014 in addition to the individual explanation that may have been submitted by the owners of the buildings and pass appropriate orders. This court further directed that until a final decision is taken by the Board, the Board shall not take any coercive steps against the petitioner-companies.

3. Alleging that inspite of the said order, the said Telecom tower installed on premises bearing House No.361 (New), 4-4-96, Chintal Bazar, Bollaram, Secunderabad was sealed before passing orders on the representation submitted by the petitioner and therefore amounts to committing contempt of the orders of this Court, this contempt case is filed.

4. However, as fairly stated by learned counsel for the petitioner that while submitting the representation, the Board was not informed that this tele communication tower also belongs to them. In view of the same it cannot be said that the Board has violated the orders passed by this Court. Therefore, I do not see any justification to continue the contempt proceedings against the respondent-Board on the allegation of violating the orders of this Court.

5. Accordingly, this contempt case is closed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Contempt Case shall stand closed.
