This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 and 4 in Crime No.772 of 2026 of Jawaharnagar, Kushaiguda Division, Medchal-Malkajgiri District, registered for the offences punishable under Sections 420, 406, 467, 471, 447, 427, 323 read with 34 of Indian Penal Code (for short 'IPC').

The brief facts of the case are that on 07.07.2025 at about 12:30 hours, the complainant lodged a complaint before P.S Jawahar Nagar alleging cheating and criminal breach of trust against one Burra Ashok Goud and others. According to the complaint, the complainant had purchased a plot admeasuring 70 square yards situated at Balajinagar, Kapra Mandal, Medchal District, on 30.11.2022 from one Boyini Santosh through mediator Burra Ashok Goud. Subsequently, in September 2023, the complainant allegedly borrowed an amount of Rs.50,000/- from Ashok Goud by pledging the original land documents and later repaid the said amount along with interest. However, despite repayment, Ashok Goud allegedly failed to return the original documents on one pretext or another.
The complainant further alleged that in March 2024, when he visited the subject property, he found one Gangadhar undertaking construction over the plot. Upon enquiry, he came to know that Ashok Goud had allegedly sold the said land fraudulently to Gangadhar on 27.10.2023 through one S.Papaiah by forging the complainant's signature. Based on the said allegations, the complainant requested legal action against the accused persons.
complaint, the police registered FIR in Cr. No. 772/2025 for the offences punishable under Sections 406 and 420 IPC and took up investigation. Hence, action was sought against the accused.

Heard Mr.C.Kumar, learned Counsel appearing on behalf of the petitioners as well as Mr.Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent-State.

The petitioners are accused Nos.1 and 4 in Crime No.772 of 2026. Initially, the petitioners were not arrayed as accused in the complaint. Subsequently, on the basis of confessional statement of accused No.2, the petitioners have been arrayed as accused Nos.1 and 4.

Learned counsel for the petitioners has read out the complaint, wherein the role of the petitioners has not been made out. It is submitted that the petitioners are subsequent purchasers of the property from accused No.3 and therefore they have falsely implicated as accused Nos.1 and 4. Therefore, they prayed for grant of pre-arrest bail by allowing the Criminal Petition.

On the other hand, learned Public Prosecutor opposed the grant of bail and has furnished the copy of the instructions received by him and read out the confessional statement of accused No.2, in which it was stated that the petitioners are the purchasers of the land, who have committed the crime by lodging the criminal complaint with an intention to grab the scheduled property by creating fabricated documents. Therefore, at this stage, granting of pre-arrest bail to the petitioners does not arise. Hence, he prayed the Court to dismiss the criminal petition.

Having regard to the original complaint given by the complainant and also to the fact that petitioner i.e, accused No.1 is GHMC Employee and is not likely to run away and the petitioner No.2 being the accused No.4 is wife of accused no.1, this Court is inclined to grant pre-arrest bail to the petitioners/accused Nos.1 and 4, subject to the following conditions:
i.
The petitioners-accused Nos.1 ad 2 shall surrender before the Station House Officer, Jawaharnagar Police Station, within two weeks from today,
and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner-accused No.1 shall appear before the concerned Investigating Officer as and when required and shall not leave the headquarters without informing the Investigating Officer.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
