THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.18286 of 2019 ORDER:

This writ petition is filed challenging the notice, dated 15.07.2019, whereby the petitioner was asking to pay an amount of Rs.4,18,266/- for utilization of excess space for cycle and scooter stand No.2 in Janagaon bus station (Erstwhile Warangal District) and further asking to pay rent @ Rs.57,587/- with effect from 01.06.2019. 2.

Heard learned counsel for the petitioner and Sri B.Mayur Reddy, learned Standing Counsel for the respondents. 3.

Learned counsel for the petitioner submits that without any enquiry and without any show-cause notice, the impugned order is straightaway issued asking the petitioner to pay an amount of Rs.4,18,216/-, which is in violation of principles of natural justice. He further submits that the petitioner never utilized the place more than allotted to him for parking and the petitioner filed an explanation, dated 30.07.2019, to the impugned notice, dated 15.07.2019. 4.

On the other hand, Sri B.Mayur Reddy, learned Standing Counsel, submits that the impugned notice, dated 15.07.2019, can be treated as a show-cause notice, since the petitioner already filed explanation on 30.07.2019.

In view of the same, the impugned order, dated 15.07.2019, is treated as a show-cause notice. Since it is stated that the petitioner filed an explanation on 30.07.2019, the 4th respondent-Depot Manager

shall consider the same after giving opportunity of hearing the petitioner. Till then, no coercive steps shall be taken for recovery of the amount under impugned notice.

With the above directions, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No costs.
