THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38277 of 2016 ORDER:

This writ petition is filed seeking to call for the records in FIR No.41 of 2016 and to quash the same.

Heard and perused the material available on record. The case of the petitioner is that the 3rd respondent lodged the present complaint alleging that A-3 introduced the 3rd respondent to A-1 and the petitioner, who is A-2, saying that A-1 and A-2 would provide Central Government job to him and demanded Rs.4,50,000/- as expenses and the 3rd respondent deposited Rs.3,75,000/- in the account of A-1, when A-1 and others failed to provide the job, the 3rd respondent lodged the present complaint. The grievance of the petitioner is that the main allegations are only against A-1 and the petitioner is implicated as an accused to bring pressure on A-1 to return the money, as the petitioner is friend of A-1 and to extract money with a dishonest intention from the petitioner.

Considering the grievance of the petitioner, the 2nd respondent is directed to complete the investigation in FIR No.41 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
