O R D E R

This Criminal Petition is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.1 seeking to enlarge him on bail in connection with COR No.25 of 2026, on the file of Prohibition and Excise Station, Kondapur, registered for the offences punishable under Section 8(c) read with 22(b), 27(b)

of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act').

The brief facts of the case are that on 16.04.2026, the complainant conducted an inspection and found accused in possession of 6.09 grams of MDMA and seized the said contraband. Basing on the same, a criminal case was registered against the accused for the alleged offences. 3.

Heard Sri Sunil Kumar, learned counsel for the petitioner as well as Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondentState. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been in judicial custody since 16.04.2026 and that the seized contraband i.e., 6.09 grams of MDMA, constitutes an intermediate quantity and that the material part of investigation is already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that although the seized contraband falls under the category of intermediate quantity, the investigation is still ongoing. Therefore, granting bail to the petitioner, at this stage, does not arise. Hence, prayed the Court to dismiss the Criminal Petition.

Considering the submissions made by learned counsel for the respective parties and upon perusal of the material available on record, it is evident that the seized contraband, i.e., 6.09 grams of MDMA, falls under the category of intermediate quantity and that the petitioner has been in judicial custody since 16.04.2026, and a substantial portion of the investigation has already been completed. Taking into account the overall facts and circumstances, the quantity of contraband seized and the period of incarceration, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:

1) The petitioner/A1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand

only), with two sureties for a like sum each to the satisfaction of the learned XIII Additional District and Sessions Judge, Cyberabad, Ranga Reddy district at L.B. Nagar.

2) The petitioner/A1 shall appear before the concerned Investigating Officer on every Monday between 10:00 a.m. and 5:00 p.m. for a period of four (08) weeks or till filing of the charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

3) The petitioner/A1 shall furnish his mobile number and surrender his passport, if any, before the trial Court and shall not leave the Country without prior permission from the trial Court.

4) The petitioner/A1 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

5) The petitioner/A1 shall not hamper the investigation or tamper with the prosecution evidence in any manner. 6) The petitioner/A1 shall abide by the conditions stipulated under Section 480(3) of the BNSS.

7) In the event of breach of any of the above conditions, the prosecution is entitled to file appropriate application for cancellation of bail granted to the petitioner/A1. 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
