ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.5, in Crime No.83 of 2026 of INSP ADMIN (DD) Police Station, Hyderabad District, registered for the offences punishable under Sections 316(4), 336(3), 340(2) r/w 61(2) of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The case of the prosecution is that, on 22.04.2026, the de-facto complainant lodged a report before the police stating that the accused Smt. Dasari Kavitha, while working as Senior Manager in Yashoda Hospitals,

colluded with her family members and associates to create firms and manipulate purchase transactions by inflating prices and routing supplies through those firms, thereby causing wrongful loss to the company and wrongful gain to themselves. Hence, the complainant requested the police for necessary action. Basing on the said complaint, the police registered the above case for the above said offences.

Heard Sri Kalidas Vamshi Krishna, learned counsel appearing on behalf of the petitioner as well as Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and he is no way concerned with the allegations leveled against him. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, the learned Additional Public Prosecutor opposed petition stating that allegations leveled against the petitioner are grievous in nature. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is alleged to be friend of prime accused No.1. Upon perusal of the entire complaint, the allegations do not disclose any specific overt acts against the petitioner/Accused No.5. There is no prima facie to show that the accused No.5 has committed any of the offences alleged against him.

Considering the facts and circumstances of the case, the nature of the allegations and the stage of investigation, this Court deems it fit to grant pre-arrest bail to the petitioner/accused No.5, subject to compliance of the following conditions:

i.

The petitioner shall surrender before the Station House Officer, INSP ADMIN (DD) Police Station, Hyderabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on condition of petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five

Thousand only) with two sureties, for a like sum each.

ii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

iii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with Investigating Officer in investigating the case.

Accordingly, this Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
