Mohd. Imaduddin, R.R. Dist. v. The Joint Transport Commissioner, Hyd And Another
HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.12779 of 2011 ORDER:
The relief sought for in this Writ Petition is for a mandamus to declare the action of the Motor Vehicles Inspector in seizing the petitioner's vehicle bearing registration No.AP 29 U 3692 seized under check report No.1465007 dated 23.04.2011, as arbitrary and illegal. While admitting the Writ Petition on 30.04.2011 this Court, passed an interim order in WPMP No.15544 of 2011, granting the petitioner liberty to make an appropriate application, before the Joint Transport Commissioner, for release of the vehicle, and observed that, if any such application was made, the same shall be considered and disposed of in accordance with law within three days from the date of receipt of such application. This order was passed more than 61⁄2 years ago. Sri K.
Jamali, Learned Counsel for the petitioner expresses ignorance as to what transpired thereafter. Since this Court had earlier directed the respondents to consider the petitioner's representation, and such a representation must have been considered and orders passed, it is evident that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court. The Writ Petition is dismissed as infructuous. The miscellaneous petitions pending, if any, shall stand closed. No costs.
