THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2741 of 2016 ORDER:
This Criminal Petition is filed by the petitioners-A.1 t& A.2 under Section 482 Cr.P.C., to quash the proceedings in FIR No.242 of 2015 on the file of Mangalghat Police Station, Hyderabad for the offences under Sections 406, 420, 498A, 323, 506, 120B r/w 34 IPC and Sections 3 & 4 of Dowry Prohibition Act.
Heard.
On perusal of the entire material available on record, prima facie there are some allegations as against the petitioners and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at the threshold. At this stage, learned counsel for the petitioners submitted that in view of the pendency of the above crime, the petitioners apprehend arrest and also harassment in the hands of the police.
In view of the above, the petitioners hereby are directed to appear before the police concerned on or before 30.05.2016 and each of them shall execute a personal bond for a sum of Rs.5,000/- with one surety for the likesum to the satisfaction of S.H.O. concerned for their future appearance. On such execution of bond, the police concerned are directed to complete the investigation into the crime without arresting the petitioners herein and file a final report, if any, in accordance with law. The petitioners are directed to appear before the investigating agency as and when required and cooperate with the investigating agency.
Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
