THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.134 OF 2017 ORDER:

Heard learned counsel for the petitioner and also the learned counsel for the 1st respondent and perused the grounds urged in the transfer criminal petition.

There are no just grounds to consider the request to transfer the criminal case from the II Additional Judicial First Class Magistrate Court, Tanuku, West Godavari District, to Hyderabad or Ranga Reddy, in any courts, but for at best to transfer to the headquarters of the West Godavari at Eluru.

Having regard to the above observations, this transfer criminal petition is allowed only to the extent of withdrawing C.C.No.697/2015, from the file of II Additional Judicial First Class Magistrate Court, Tanuku, West Godavari District, and transferring the same to the Principal Junior Civil Judge of Eluru, to dispose of the matter according to law by virtue of this order. Both parties are directed to appear before the court on 11.09.2017 without further notice.

Accordingly and in the result, the transfer criminal petition is partly allowed. Pending miscellaneous petitions, if any, shall stand closed.
