This Criminal Petition is filed for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.1, in Crime No.111 of 2026 of the Police Station, Jogipet, Sangareddy District. The offences alleged against the petitioner are punishable under Section 108 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short, "BNS").

The brief facts of the case are that Dathu resident of Tadmanoor village is due an amount of Rs.3,00,000/- to him and upon which Jogipet Police took him into custody and upon knowing the same, her husband Ramchander also went to Police Station as Dathus is due of rs.80,000/- to her husband.
At the same time Sarpanch Anil Reddy came to the Police Station in support of Dathu and informed him not to give amount to anyone and if case is registered, he will provide Bail to Dathu and left the Police station. Later Bethaiah called Sarpanch Anil Reddy over phone and informed him that Ramchander spoken bad words about him. Upon which Sarpanch Anil Reddy called her husband and spoken to Sarpanch Anil Reddy and he abused. Upon which her husband mentally upset and consumed unknown pesticide poison at about midnight 02.00 A.M., and when was vomiting, she woke up and took her husband to Jogipet Hospital and thereafter shifted to Sangareddy and when his condition was critical he was shifted to Osmania Hospital, Hyderabad. While undergong treatment her husband died at 02.00 P.M., in the afternoon on 08.05.2026 and therefore, she requested to take necessary action against the Sarpanch Anil Reddy and Bethaiah. 3.
Heard learned counsel appearing on behalf of the petitioner and learned Assistant Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is in no way connected with the allegations made by
the complainant, however, he was falsely implicated in the case. He further submitted that the offence under Section 108 r/w. 3 (5) of BNS is punishable with an imprisonment of less than seven (7) years. He further submitted that the petitioner is ready to co-operate with the investigation and ready to abide by any of the conditions imposed by this Court. Therefore, he prayed this Court to grant pre-arrest bail to the petitioner. 5.
On the other hand, the learned Assistant Public Prosecutor, opposed for grant of pre-arrest bail to the petitioner stating that specific allegations that are eveled against him. 6.
Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner/Accused No.1, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Jogipet Police Station, Sangareddy District, within two (2) weeks from today and on such surrender, the said Station House Officer shall release him on bail on his executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik
Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case. iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m. and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
