THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1598 OF 2016 ORDER:

This revision is filed by the petitioner-accused No.1 challenging the docket order dated 28.3.2016 passed in C.C.No.244 of 2012 by the I Additional Junior Civil Judge-cum-Judicial First Class Magistrate, Bhimavaram.

The petitioner was charge sheeted for the offence punishable under Section 498-A IPC and Section 4 of the Dowry Prohibition Act in C.C.No.62 of 2010. Subsequently, the case against the petitioner was split up and renumbered as C.C.No.244 of 2012. On 18.3.2013 as the petitioner failed to appear before the trial Court, NBWs were issued against him. On 28.3.2016, the Court below adjourned the matter to 27.6.2016 as NBWs are pending against the petitioner. The petitioner filed this petition seeking to recall NBWs issued against him. Learned Additional Public Prosecutor opposed this petition. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The petitioner-accused No.1 is directed to surrender before the Court concerned on or before 15th July, 2016 and move an application seeking to recall NBWs issued against him. On such surrender, the Court below is directed to recall NBWs issued against the petitioner and release him on his executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the Court below. The petitioner is directed to appear before the Court below in the above C.C. on all hearing dates."

Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand

closed.
