HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7209 of 2016 ORDER:

This petition is filed by the petitioner/accused under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.924 of 2015-16 on the file of Prohibition & Excise Station, Narsipatnam, Visakhapatnam District, for the offence punishable under Section 8(c) read with 20(b)(ii) of NDPS Act. Heard and perused the material available on record. A perusal of the record discloses that the ganja seized from the possession of the petitioner is 55 kgs., which is more than commercial quantity. Hence, this Court is not inclined to grant bail to the petitioner at this stage.
