ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioners, who are arrayed as accused Nos.1 to 14 in Crime No.120 of 2026 on the file of Bijinapally Police Station, Nagarkurnool District, registered for the offences punishable under Sections 329(3), 324(4), 118(1), 115(2), 352, 351(2) and 109 read with 3(5) of BNSS.

The brief facts of the case are that on 11.05.2026 at about 10:00 hours, the de facto complainant lodged a written complaint before Bijinapally Police Station alleging that while he and others were levelling the land in Sy.No.101 situated at the outskirts of Bijinapally village, the accused persons unlawfully trespassed into the land, picked up a quarrel and attacked him with sticks and stones causing bleeding injuries and that the accused persons assaulted him with hands and legs and attempted to kill him. Basing on the said complaint, police registered the above said crime.

Heard Sri K. Rajesh Reddy, learned counsel for the petitioners as well as Sri M. Vivekananda Reddy, learned Assistant Public Prosecutor appearing for Respondent - State.

Learned counsel for the petitioners submitted that the petitioners were falsely implicated in the above crime due to political rivalry and civil disputes relating to land and that there exists a civil suit pending between the parties vide O.S.No.17 of 2026 on the file of learned II Additional Junior Civil Judge, Ngarkurnool (FAC I Addl. Junior Civil Judge, Nagarkurnool) with regard to very same property and the present complaint was lodged only to pressurize the petitioners in the civil dispute. He further submitted that there was an unexplained delay of two days in lodging the complaint and that the allegations of grievous injuries and attempt to murder are false and exaggerated. He

contended that the accused No.1 is the owner and possessor of the subject land and on the alleged date of incident, some of the accused were at Hyderabad attending a party event.

Learned Assistant Public Prosecutor opposed the petition contending that the allegations in the complaint clearly disclose the involvement of the petitioners in the commission of the offences and that the de facto complainant sustained bleeding injuries in the said attack and specific overt acts were attributed against the accused persons in the complaint. Therefore, he prayed to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that there are civil disputes between the petitioners and the de facto complainant. Further, as seen from the medical report filed by the learned Assistant Public Prosecutor, the injuries sustained by the victim are simple in nature. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Bijanapally Police Station, Nagarkurnool District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on

bail on executing personal bond for Rs.50,000/- each with two sureties, for the like sum each. ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and shall co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any, pending in this petition, shall stand closed.
