HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11851 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for the Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the action of the 4th respondent in passing orders dated 24.03.2015 by suspending the authorization of F.P.Shop No.37 of J.Rampuram Village, Vajrakarur Mandal, Anantapur District, as illegal and arbitrary and for a consequential direction to the respondents to continue him as fair price shop dealer.

3. Basing on the report of the 5th respondent-Tahsildar, Vajrakarur Mandal dated 10.03.2015, the 4th respondent-Revenue Divisional Officer, Anantapur, has issued a show cause notice dated 18.03.2015 to the petitioner framing four charges against him. The petitioner submitted his explanation to the show cause notice. Thereafter the 4th respondent passed impugned order suspending the authorisation of the petitioner.

4. Perusal of the show cause notice, shows that the charges levelled against the petitioner are vague and general in nature. The 4th respondent has not considered the explanation submitted by the petitioner and passed the impugned order in a mechanical way.

5. In the circumstances, the impugned suspension order dated 24.03.2015 passed by the 4th respondent is set aside. However, this order does not preclude the authorities to conduct regular enquiry into the allegations made against the petitioner.

6. The writ petition is accordingly disposed of. Miscellaneous applications, if any, in this writ petition, shall stand closed. No order as to costs.
