THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22238 OF 2016 ORDER:

Heard the learned Counsel for the petitioners and the learned Government Pleader for Home. With consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.

2. The present Writ Petition is filed with the following prayer: "to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent Nos.3 to 5 herein in summoning the petitioners to the police station without any complaint against them and threatening to implicate them in FIR No.212 of 2016 of Sarpavaram PS, Kakinada, East Godavari District as illegal, arbitrary and violative of the fundamental rights guaranteed under the Constitution of India and consequently direct the respondents herein not to summon the petitioners to the police station in connection with the FIR stated supra."

4. The grievance of the petitioners appears to be that respondents 3 to 5 are illegally and intentionally calling the petitioners to the police station without there being any crime registered against them.

5. Learned Government Pleader for Home submits that allegations made in the writ petition are all false and if the petitioners are to be summoned to the police station, respondentspolice will follow the due process of law.

6. Having regard to the above, the Writ Petition is disposed of directing the respondents-police not to summon the petitioners to

the police station except in accordance with law. Needless to mention that the respondents shall follow the due process of law while arresting the petitioners in the event of a crime being registered against them.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
