Eddula Balaiah v. The State Of Telangana
IN THE HIGH COURT FOR THE STATE OF TELANGANA
AT HYDERABAD THE HON'BLE SRI JUSTICE G.M.MOHIUDDIN WRIT PETITION No.16691 of 2026 DATED: 21.05.2026 Between:
Eddula Balaiah ... Petitioner AND The State of Telangana, Rep. by its Principal Secretary, Energy Department, Secretariat, Hyderabad & 4 others ... Respondents ORDER:
Heard Mr. Kasireddy Jagathpal Reddy, learned counsel appearing for the petitioner; Mr.N.Sreedhar Reddy, learned Standing Counsel for TSSPDCL appearing for respondent Nos.3 to 5.
2.
Learned counsel for the petitioner submits that as per the direction of this Court in W.P.No.27276 of 2022 dated 22.07.2022, it would redress the grievance of the petitioner if the respondent No.3 be directed to comply with the direction of the Court in the said Writ Petition. 3.
On the other hand, learned Standing Counsel for respondent Nos.3 to 5 submits that for providing a fresh electricity meter to the house of the petitioner,
the payment of outstanding dues of the petitioner is one requirement and another requirement would be to make a formal fresh application for the fresh electricity meter to the house of the petitioner.
4.
Learned Standing Counsel also submits that the petitioner is not able to show the making of the fresh application seeking installation of the fresh electricity meter as directed by this Court in the order dated 22.07.2022. 5.
Learned counsel for the petitioner further draws the attention of this Court to a letter addressed by the office of the Law Attache to the Superintending Engineer dated 18.04.2026, and particularly draws the attention of this Court to paras 3, 3.1, 3.2, 4 and 5 of the correspondence between office of the Law Attache and the Southern Power Distribution Company of Telangana Ltd. Learned counsel relies upon the said correspondence between the office of the Law Attache and the Superintending Engineer to show that even according to the Department, the pendency of the title dispute in respect of the subject premises in O.S.No.3067 of 2019 on the file of learned IX Junior Civil Judge, City Civil Court, Hyderabad, is the ground for failure to provide electricity connection and not the failure to make a fresh application for fresh electricity meter connection.
6.
In view of the above, this Court is of the considered view that the petitioner shall make a fresh application together with the requisite fee duly enclosing all requisite annexures to the concerned authority for a fresh
electricity meter to the premises. Upon such application being made, the respondent Nos.2 to 5 shall take necessary steps to process the application as expeditiously as possible, preferably within a period of three (3) weeks from the date the application is made.
7. With the above observation, this Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous applications pending, if any, shall stand closed. ____________________________ JUSTICE G.M.MOHIUDDIN Date: 21.05.2026 KRL
