ORDER

The petitioner-accused No.2 filed the present application under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to grant bail to him in Crime No.990 of 2025 of Kushaiguda Police Station, registered for the offences punishable under Sections 8c r/w 22(c) and 27(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act').

The case arose out of the contraband seized by the prosecution, i.e., 12 LSD bolts weighing 0.2 grams. Due to which, the petitioner was arrayed as accused No.2.

Heard Mr. Kodari Mallikarjuna, learned counsel for the petitioner and Mr. Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State. 3.

Learned counsel for the petitioner submitted that no substance was found in the possession of the petitioner and that the petitioner was arraigned as accused basing on the confession statements of the co-accused which is not permissible in view of the Judgment of the Hon'ble Supreme Court in Tofan Singh v. The State of Tamilnadu1. Further, the petitioner was apprehended and remanded to judicial custody on 18.03.2026 and the investigation is substantially completed. Hence, learned counsel prayed this Court to enlarge the petitioner on bail.

On the other hand, learned Assistant Public Prosecutor opposed for grant of bail stating that the allegations leveled against the petitioner are serious in nature. Further, the 1 2021(4) SCC 1

investigation is not yet completed. Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the contraband seized 12 LSD bolts weighing 0.2 grams, which is a commercial quantity. Further, in view of rigour of Section 37 of NDPS Act, the petitioner is not entitled for the bail. Hence, this Court is not inclined to grant bail to the petitioner and the same is liable to be dismissed. 7.

Accordingly, the Criminal Petition is dismissed. Miscellaneous applications, if any pending, shall stand closed.
