HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12784 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in issuing proceedings dated 05.06.2002 ordering to recover a sum of Rs.20,517.54 ps from the salary of the petitioner towards shortage of 105 items, as illegal and arbitrary.

While admitting the writ petition, this Court granted interim stay of all further proceedings in pursuance of the impugned proceedings dated 05.06.2002, vide orders dated 17.07.2002 in WPMP No.15880 of 2002.

When the matter is taken up for hearing, learned counsel for the petitioner submits that during pendency of the writ petition, the petitioner has retired from service on attaining the age of superannuation.

Learned standing counsel for the respondents has contended that in view of the interim orders, no further orders are necessary in the writ petition.

In view of the above, the writ petition is closed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
