HON'BLE SRI JUSTICE A.RAJASHEKER REDDY MACMA.No.3681 of 2014 JUDGMENT:
This appeal is filed against the order and decree dated 26-09-2012 in M.V.O.P.No.1081 of 2010, wherein the Court below has granted compensation of Rs.19,32,586/- against the appellant. Learned counsel for the appellant submits that without issuing notice to the appellant, order has been passed by the Tribunal. Learned counsel for the 4th respondent as well as counsel for the respondents 1 to 3 stated that the matter can be remanded on that ground. In view of the same, the appeal is allowed and the impugned order and decree is set aside and the matter is remanded back to the Tribunal for disposal in accordance with law. The Tribunal is directed to dispose of the OP within a period of three months from the date of receipt of copy of order. It is also left open for the claimants to implead the driver of the vehicle involved in the accident, if they are so advised.
As a sequel to the disposal of this appeal, miscellaneous petitions, if any, pending shall stand closed.
