THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4709 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Criminal Procedure Code by the petitioner/accused in Crime No.4/RCA-CIU-ACB/2022 on the file of CIU, ACB, Hyderabad District, registered for the offences punishable under Sections 13(1)(b), read with 13(2) of Prevention of Corruption Act, 1988 (as amended in 2018). 2.

The case of the petitioner is that while he was working as Zonal Commissioner, GHMC, the ACB conducted raid on 20.04.2022 on the suspicion of being in possession of disproportionate assets to the extent of 2.96 crores and the petitioner was arrested on 21.04.2022.

As seen from the Remand Report, the entire details of search conducted and the properties owned by the petitioner are tabulated. 4.

In the said circumstances, when all the details of the petitioner/accused are in the knowledge of the investigating agency and the evidence being documentary in nature, further detention of the petitioner is not necessary.

In the said circumstances, this Court is inclined to grant bail to the petitioner/Accused subject to the following conditions:

i) The petitioner/Accused shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum each to the satisfaction of the I Additional Special Judge for Trial of SPE & ACB Cases at Hyderabad.

ii) The petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.30 a.m. and 01.00 p.m. for a period of two (02) months and thereafter as and when required.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

iv) It is needless to say that the petitioner shall assist the investigation and provide all such information within legally permissible limits.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed. __________________ K.SURENDER, J 15.06.2022 tk
