THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.869 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an order, writ or direction more particularly in the nature of writ of mandamus declaring the action of respondent Nos.2 and 3 in not taking any action on the illegal constructions being made by the 4th respondent in the pathway adjacent to the petitioner's house without obtaining any permission is illegal, arbitrary and is in violation of Greater Hyderabad Municipal Corporation Act, 1955 and consequently direct the respondents to remove the illegal constructions being made by the 4th respondent and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.3 herein to consider the representation, dated 22.10.2016, of the petitioner and pass appropriate orders in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.3 is hereby directed to consider the representation, dated 22.10.2016, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
