B. Sarvotham Reddy, learned counsel for the appellant, would submit that the appellant - Mr. S. Dhananjaya Rao, who is arraigned as Accused Officer No.1 in C.C. No.32 of 2001 on the file of the Principal Special Judge for SPE and ACB Cases, City Civil Court, Hyderabad, is no more. In support of the same, he filed a copy of Death Certificate issued by the Registrar (Birth and Death), Machilipatnam Municipality, Andhra Pradesh State, dated 28.08.2018.

2. Perusal of the said Death Certificate discloses that the death of the appellant - Accused Officer No.1 occurred on 20.07.2018 at Lakshmi Srinivasa Nursing Home.

3. Mr. T.L. Nayan Kumar, learned Additional Standing Counsel - cum - Special Public Prosecutor for ACB Cases, Telangana State, appearing for the respondent - State, on instructions, confirmed the factum of death of the appellant - Accused Officer No.1.

4. In view of the above, the present Criminal Appeal stands abated and accordingly the same is dismissed as abated. As a sequel, miscellaneous applications, if any, pending in the appeal shall stand closed.
