HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40694 OF 2016 ORDER:

The present writ petition is filed seeking to declare the action of the 2nd respondent in not taking any steps pursuant to the complaint lodged by the petitioner on 24.02.2016 against the respondents 4 to 7, even after lapse of more than 9 months, as illegal and arbitrary, and consequently, direct the respondents 2 and 3 to register the crime on the basis of the complaint of the petitioner. Learned counsel for the petitioner submitted that when a complaint was made before the Station House Officer, Chilakalaguda Police Station - 3rd respondent, against the respondents 4 to 7, the same was not registered and hence, following the procedure under the provisions of Cr.P.C., she made a complaint to the Superior Officers of the 3rd respondent i.e.

the Commissioner of Police, Basheerabagh - 2nd respondent and also to the Director General of Police, Telangana State, Hyderabad, in the month of February 2016, but no action was taken by them also. Hence, the present writ petition. Heard and perused the material available on record. Considering the facts and circumstances of the case and the grievance of the petitioner, the respondents 2 and 3 are directed to register the case against respondents 3 to 7, if the complaint lodged by the petitioner, dated 24.02.2016, discloses any cognizable offence. If the petitioner is aggrieved over the action of the official respondents, she is at liberty to approach superior officer of the official respondents and also to approach the Court concerned, by invoking provisions under 200 of the Criminal Procedure Code.

With the above directions, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
