This Criminal Petition is filed seeking grant of bail to the petitioner, who is arrayed as sole accused in Crime No.22 of 2026 on the file of the EOW (Cyb) Cyberabad Police Station, Cyberabad, registered for offences punishable under Sections 316(2), 318(4) of Bharatiya Nyaya Sanhita, 2023 and Section 5 of the Telangana Protection of Depositors of Financial Establishments Act, 1999.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for respondent-State.

The brief facts of the case are that the de facto complainant was introduced to the accused in the year 2024 through a mutual friend informing that the accused was engaged in forex trading and stock market business. The accused induced the complainant to invest money in her business by promising monthly returns with an interest @ 3% to 5%. Believing the same, the complainant and his sister, who are residing in UK, have invested a total amount of Rs.67,00,000/- through online transfers during the years 2024 and 2025. It is stated that the complainant received the returns till March, 2025. Thereafter, no returns were paid by the accused which led to the filing of the present complaint.

Learned counsel for the petitioner/accused submits that the petitioner is innocent and has been falsely implicated in the present case, and that no specific overt acts are attributed to her.

Learned Additional Public Prosecutor contended that the petitioner/accused was engaged in online forex trading and stock market business and has induced several

individuals to invest money by promising attractive monthly returns. It is further contended that there are several other victims and that a huge amount is involved. 6.

From a perusal of the record, it appears that the complainant received returns up to from March-2025 and that no returns were paid from April-2025 onwards. Though, it is stated that there are several other victims and huge amount is involved, these aspects require proper investigation. The petitioner was arrested on 16.04.2026 and he is languishing in the judicial custody since then. 7.

Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused, subject to the following conditions:

i. The petitioner/accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a

like sum each to the satisfaction of the learned Principal Additional Junior Civil Judge-cum-Judicial Magistrate of First Class at LB Nagar, Ranga Reddy District.

ii. After release, the petitioner/accused shall appear before the concerned SHO between 10:00 a.m. to 01.00 p.m, on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required and shall co-operate with the investigation.

iii. The petitioner/accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv. The petitioner/accused shall not tamper with the investigation. In the

event that the petitioner is found to be involved in any other offence subsequent to the grant of bail, the respondent police authorities shall be at liberty to seek appropriate cancellation of the bail order.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
