THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4726 of 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 Criminal Procedure Code, 1973, seeking regular bail to the petitioner/Accused in Crime No.156 of 2022 on the file of Asifnagar Police Station, Hyderabad District, registered for the offences punishable under Sections 498(A), 306 of Indina Penal Code.

Heard learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the respondent-State. 3.
The case of the prosecution is that a complaint was filed on 06.05.2022 by the father of the deceased alleging that his daughter was married to the petitioner herein three years prior to the incident; that they were not having any children and the deceased was working in a firm wherein she used to use her owners phone; and that there were frequent quarrels between the deceased and the petitioner and the petitioner alleged to have harassed the deceased physically and mentally. On 06.05.2022, at 6.30 a.m., the deceased was found hanging to the fan. Aggrieved by the said suicide of his daughter, the present complaint was filed alleging harassment for which reason crime was registered for abatement of suicide.

The petitioner/accused was arrested on the same day i.e. 06.05.2022 and he was in jail since then.

As seen from the Remand Report, six witnesses were examined apart from other independent punch witnesses. 6.
In the said circumstances, the petitioner/accused can be released on bail on the following conditions. i) The petitioner/accused shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the I Additional Chief Metropolitan Magistrate, Nampally.
ii) The petitioner/accused shall appear before the concerned Station House Officer on every Monday between 10.30 a.m. and 01.00 p.m. for a period of three (03) months or until filing of the charge sheet, whichever is earlier.
iii) The petitioner/accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
