The petitioner filed the present Criminal Petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking grant of anticipatory bail in the event of his arrest in connection with FIR.No.31 of 2026 of Beerpur Police Station, Jagitial, registered for the offence punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023 (for short "the BNS"). 2.
Heard Mr.Mandru Sambasiva Rao, learned counsel for the petitioner and Mr.Arun Kumar Doddla, learned Additional Public Prosecutor, appearing for respondent No.1-State. 3.
Brief facts of the case are that, on 04.03.2026, respondent No.2/complainant lodged a complaint stating that four months
prior, the marriage of her daughter (deceased) was settled with one Galipelli Naresh, S/o Bhumaiah, resident of Kothur Village. Subsequently, the petitioner/accused allegedly sent messages to the said Naresh through Instagram stating that the deceased had three boyfriends, had developed pregnancies twice, and also requested him to enquire about the same with the neighbours. Upon receipt of the said messages, the said Naresh allegedly took screenshots and forwarded them respondent No.2/complainant, stating that he would decide about the marriage after discussing the issue. Thereafter, the deceased was subjected to severe mental agony and, on 01.03.2026 at about 4:00 PM, she allegedly committed suicide by consuming Godrej Hair Oil. Immediately thereafter, the deceased was shifted to the Government Hospital by ambulance. On 03.03.
2026, she was shifted to Apex Hospital, Jagtial, and thereafter taken to Gandhi Hospital for better treatment. While undergoing treatment, she died on the same day at about 5:00 PM. As per the respondent No.2/complainant's complaint, FIR No.31 of 2026 was registered against the petitioner/accused for the offence punishable under Section 108 of the BNS before Beerpur Police Station, Jagitial.

Learned counsel for the petitioner would submit that the petitioner was arrayed as accused in FIR No.31 of 2026, before Beerpur Police Station, Jagitial, for the offence under Section 108 of the BNS, with the allegation that the petitioner has forwarded message to one Galipelli Naresh regarding the deceased and due to which she committed suicide. He further submits that none of the ingredients of Section 108 of the BNS are attracted for the abetment. He further submits that the petitioner filed Crl.P.No.6574 of 2026 seeking quashment of FIR No.31 of 2026 before Beerpur Police Station, Jagitial. While Crl.P.No.6574 of 2026 is pending, the petitioner apprehends arrest in the hands of respondent/police. Therefore, this criminal petition is filed seeking grant of anticipatory bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor would submit that no interim relief has been granted in Crl.P.No.6574 of and subject pending of Crl.P.No.6574 of 2026, the petitioner cannot claim anticipatory bail in the present criminal petition. He further submits that the petitioner has to cooperate with the investigation whenever necessary. Therefore, prays this Court to dismiss the present criminal petition.

This Court, having heard learned counsel for the petitioner and the learned Additional Public Prosecutor and upon perusal of the material available on record, without expressing any opinion on the merits and demerits of the case, deems it appropriate to grant anticipatory bail to the petitioner/accused, pending adjudication of Crl.P.No.6574 of 2026 which was filed seeking quashment of FIR No.31 of 2026, on the following terms and conditions:
i. The petitioner/accused is directed to surrender himself before Beerpur Police Station, Jagitial, within one week from today, and on such surrender, the petitioner/accused shall be enlarged on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of Beerpur Police Station, Jagitial. ii. The petitioner shall appear before Station House Officer concerned on every Monday and Friday between 10:00 am to 2:00 pm for a period of eight
(8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall cooperate with the Investigating Officer and shall not tamper with the evidence directly or indirectly.
iv. The petitioner shall deposit his passport, if any, before the learned trial Court and he shall not leave the jurisdiction limits of the learned trial Court without prior permission. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS). v. In the event of any breach of the above conditions, the respondent shall be at liberty seek cancellation of the petitioner's bail.

Accordingly, this Criminal Petition is allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
