HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Charge Memo dated 04.06.2016 was issued to the petitioner framing two charges. Sum and substance of the allegation of first charge was, petitioner failed to supervise the works and committed irregularities in execution of works of providing gravel/sand of newly formed roads, due to which an amount of  3,37,972/- was misappropriated. Sum and substance of the allegation of second charge was, petitioner made payment without verifying the pass orders and check measurement certificates in Measurement Books. Petitioner claimed to have submitted his explanation on 18.07.2016 denying the allegations made against him. Petitioner now alleges that there is no progress in the enquiry.

Petitioner claims that now he is working as Extension Officer and is eligible for promotion to the post of Divisional Level Panchayat Officer/ Mandal Parishad Development Officer. Petitioner alleges that though otherwise qualified to be promoted in the vacancies reserved for Scheduled Castes, on the ground that disciplinary proceedings are pending, he is not considered for promotion. According to the learned counsel for petitioner, no justifiable reason or cause and for no fault of the petitioner, disciplinary proceedings are kept pending for more than three years. 2.

During the course of hearing, learned counsel for petitioner fairly submits that for the present petitioner would be satisfied if direction is issued to the disciplinary authority to conclude the disciplinary proceedings within a reasonable period.

Having regard to the said submission, Writ Petition is disposed of, directing the 2nd respondent to conclude the disciplinary proceedings as expeditiously as possible, preferably within a period of four months from the date of receipt of this order. For any reason not attributable to the petitioner, the disciplinary proceedings are not concluded, he shall be considered for promotion strictly in accordance with G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999. Pending miscellaneous petitions shall stand closed.
