HON'BLE SRI JUSTICE S.V. BHATT W.P. No.32719 OF_2013 ORDER:

The petitioner prays for Mandamus declaring the inaction of respondents in investigating the crime No.97/ 2013 and filing the charge sheet, as illegal.

The written instructions dated 28.11.2013 reads thus: "It is submitted that, on 27.11.2013 the SHO Golkonda has visited the petitioner's house. But the petitioner was not available in his house. But one red colour Innova Car bearing No. AP 13 AE 1351 parked in his house and the same time one person by name one Syed Shakir on his bike No.AP 13 L 1841 standing opposite complainant's house, when the SHO Golconda enquired with the said Shakir, he stated that he also come to meet the complainant-petitioner to discuss about his job. It is submitted that, on 28.11.2013 at about 01.30 P.M. the petitioner/complainant came to the police station along with his Advocate by name Mr.Raja Gopallavan Tayi and the SHO Golconda has recorded his detailed statement in the presence of his Advocate.

This respondent assures this Hon'ble Court that the investigation will be completed in an impartial and sincere manner and appropriate report/charge sheet will be submitted before the concerned Hon'ble Court at the earliest."

The counsel for petitioner submits that even as on date the charge sheet is not filed in the matter.

Pendency of writ petition is unlikely to result in expeditious completion of investigation. Hence, the writ petition is disposed of by this order:

The 3rd respondent, as excerpted above, if the investigation is not yet completed, completes the investigation and files charge sheet/ report within four weeks from the date of receipt of a copy of this order.

No order as to costs.
