ORDER:
This Criminal Revision Case, under Sections 397 and 401 of Code of Criminal Procedure, 1973 (for short, 'Cr.P.C') is filed aggrieved by the order, dated 09.07.2015, in Crl.M.P.No.535 of 2015 in D.V.C.No.112 of 2014 passed by the III Metropolitan Magistrate, Hyderabad.
2. Petitioner filed aforesaid M.P., to direct respondent No.1 to allow her to perform the death ceremony of her father-in-law in the house where he last resided. The Court below, after considering the facts and circumstances of the case, partly allowed the petition directing the petitioner to conduct ceremony in the ground floor without causing inconvenience to respondent No.1, who is staying in the first floor. Aggrieved by the said order, the petitioner filed the present revision.
3. Contention of the petitioner, who is mother-in-law of respondent No.1, is that the death ceremony of her father-in-law/ paternal grand father of husband of respondent No.1, needs to be performed in the house, in which respondent No.1 has been staying. The Court below, after considering the facts and circumstances of the case, directed the petitioner to conduct death of ceremony of her father-in-law in the ground floor without causing inconvenience to respondent No.1, who is staying in the first floor. I see no irregularity or legal infirmity in the impugned order so as to call for interference of this Court. Therefore, the Criminal Revision Case is devoid of merit and the same is liable to be dismissed.
4. Accordingly, the Criminal Revision Case is dismissed. Miscellaneous petitions, if any, pending in this revision shall stand closed.
