THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12634 of 2016 ORDER:

This Writ Petition is filed seeking the following relief: "For the reasons stated in the accompanying affidavit the petitioner prays that this Hon'ble Court may be pleased to issue a writ or order or direction, more particularly one in the nature of Writ of mandamus declaring the action of the 3rd respondent in not filing the charge sheet by investigating the F.I.R.No.489 of 2015 dated 29.07.2015 is arbitrary and contrary to the provisions laid down in Sec 173 of Cr.P.C and other provisions of the criminal procedure code, consequently direct the 3rd respondent to complete the investigation and file the charge sheet, in the interest of justice and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

The party-in-person is not present when the case is called. When the matter is taken up for consideration, learned Government Pleader submits that charge sheet was already filed on 29.02.2016 in C.C.No.96 of 2016, and in view of the same, no further enquiry is needed in this Writ Petition. The Writ Petition is, accordingly, closed.
