ORDER
This Criminal Revision Case is filed by the petitioners challenging the order dated 29.5.2015 passed in Crl.M.P.No.1297 of 2015 in Crime No.104 of 2015 by the Judicial Magistrate of First Class at Thorrur.
Brief facts of the case are that on 12.5.2015 at about 3 p.m., near Milk center, Thorrur to Tirumalagiri Road, the Assistant SubInspector of Police, P.S. Thorrur found a vehicle DCM going from Khammam to Hyderabad and stopped the same and enquired the driver and other persons. They revealed that they purchased 17 bulls at Thorrur cattle center to sell them at Hyderabad for cutting. Then, a case was registered and the vehicle and the cattle were seized. The petitioners filed the above Crl.M.P. before the trial Court for return of the cattle.
But the said petition was dismissed.
Hence, they approached this Court.
Learned Counsel for the petitioners submitted that they are the genuine purchasers of the cattle and they purchased them for the purpose of cultivation.
Learned Additional Public Prosecutor also submitted that interim custody of the cattle can be granted to the petitioners by imposing certain conditions.
Considering these circumstances, it is directed that the cattle (17 bullocks) seized in the above crime shall be released for interim custody of the petitioners subject to final orders to be passed at the time of disposal of the main case on execution of a personal bond for Rs.1,70,000/- (Rupees One Lakh and Seventy Thousand only) to the satisfaction of the Magistrate concerned. Further, the petitioners shall undertake to produce the cattle as and when required by the Court
concerned.
Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions pending, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 22nd June, 2015 Nn
