THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5218 OF 2017 ORDER:

This writ petition is filed challenging the action of the respondents 2 to 4 in involving civil disputes between the petitioner and the fifth respondent in O.S.No.268 of 2013 on the file of the Junior Civil Judge, Vuyyuru, Krishna District.

The learned counsel for the fifth respondent submits that the case is filed mainly based on the Order in C.R.P.No.481 of 2017, dated 03.02.2017 and the said civil revision petition is ultimately dismissed on 24.03.2017. A separate counter affidavit is filed on behalf of respondents 1 and 2 denying the averments made in the affidavit filed in support of the writ petition alleging interference. The trial Court passed an order, dated 24.03.2016 in I.A.No.805 of 2015 directed the second respondent to provide necessary police aid to the fifth respondent for proper implementation of the order, dated 09.10.2012, passed in C.M.A.No.21 of 2010. Against the said order, the C.R.P., was filed and the same was dismissed. No police aid was provided to the fifth respondent as per the orders of the Junior Civil Judge, Vuyyuru, Krishna District, dated 24.

When the petitioner and the fifth respondent were creating law and order problem at the disputed site on 11.02.2017, they were called to the Police Station and were advised to abide by the Court orders and not to take law into their hands. The allegations of threatening the petitioner to foist false criminal cases and demanding the petitioner to compromise with the fifth respondent are denied. In view of the pending civil disputes between the parties in O.S.No.268 of 2013 before the Junior Civil Judge, Vuyyuru, Krishna District, it is needless to observe that the parties are bound by the orders passed by the said Court and the police shall not interfere in the dispute.

It is needless to observe that as and when appropriate orders are passed by the trial Court, the police shall implement those orders. The writ petition is accordingly disposed of.
