Order:

This Writ Petition is filed for a Mandamus to declare the action of respondent Nos.1 and 2, in not permitting the petitioner to appear for Anatomy examination proposed to be held on 23.07.2010, as illegal and arbitrary.

The petitioner sought for a consequential direction to the said respondents to

permit him to appear for the said examination. At the hearing, Mr.A.Prabhakar Rao, learned Standing Counsel for Dr.NTR University of Health Sciences, representing respondent Nos.1 and 2, submitted that due to a mistake committed by respondent No.3 in communicating the attendance and marks of the petitioner in the internal examination, the petitioner was not permitted to appear for the Anatomy examination of the first year MBBS course and that based on the interim order passed by this Court, he was permitted to appear for the said examination. He has further submitted that subsequently, the mistake was realized and same mistake was rectified.

In the light of the above submissions of the learned Standing Counsel, the cause in this Writ Petition does not survive for adjudication and the same is, accordingly, disposed of as infructuous.

As a sequel to disposal of the Writ Petition, WPMP.Nos.22411 and 28504 of 2010, filed by the petitioner for interim relief, are disposed of. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 2nd July, 2015 LUR
