HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39008 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the official respondents to close down the rowdy sheet against him and to direct the official respondents not to interfere with his liberty.

Heard and perused the material available on record. 3.

It is stated that due to some misunderstandings the neighbours of the petitioner lodged a complaint against him and in that connection, he was tried in two criminal cases and the said cases were ended in acquittal long back and since then, there are no complaints against the petitioner. In spite of the same, the police in a very routine manner opened rowdy sheet against the petitioner. He made a representation to the official respondents requesting them to close down the rowdy sheet. But the official respondents have not closed the rowdy sheet.

In the counter, it is stated that number of cases are registered against the petitioner, and the cases, which were ended in acquittal in view of compromise, pertains to the years 2007 and 2011. Apart from that, subsequent cases registered against the petitioner were shown in the counter. The averments made in the counter indicate the fact that the petitioner is being arrested whenever there is any necessity to keep peace in that area, and therefore, it does not amount to commission of any offence by the petitioner.

Considering the circumstances of the case, the official respondents are directed to remove the name of the petitioner from the rowdy sheet.

However, if the petitioner commits any offence, it is left open to the official respondents to take appropriate action in accordance with law. 6.

Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 30th November, 2016 Nn
