THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.18370 of 2019 ORDER:

This writ petition is filed questioning the action of the second respondent in not considering and disposing of the stay petition stated to be filed by the petitioner herein on 06.06.2017 in CMA No.9 of 2017 on the file of the second respondent preferred against the orders in LTR case No.65/2011/MKP, dated 26.04.2011 on the file of the third respondent herein.

This Court on 23.08.2019 ordered notice to the unofficial respondent i.e., 5th respondent, while learned Assistant Government Pleader for Social Welfare took notice for the official respondents. Upon service of such notice, Sri V. Satyam Reddy, learned counsel, entered appearance on behalf of 5th respondent.

The learned Assistant Government Pleader for Social Welfare, on instructions, would submit that the said application filed by the petitioner is pending and it requires to be disposed of by the second respondent.

Having regard to the above said submission and inasmuch the petitioner and the 5th respondent being inconsonance to this Court issuing a direction to the second respondent to dispose of the subject stay application within a time frame, the second respondent is hereby directed to consider and dispose of the stay application filed by the

petitioner on 06.06.2017 in CMA No.9 of 2017, as expeditiously as possible, but within a period of three months from the date of receipt of a copy of this order. The second respondent while disposing of the stay application shall afford an opportunity of hearing to both the petitioner and the 5th respondent herein who are stated to be the petitioner and the respondent in the said stay application in CMA No.9 of 2017 before the second respondent.

With the above direction, the writ petition is disposed of. As this Court on 23.08.2019 while ordering notice directed both the parties to maintain status quo regarding possession, the same shall continue till disposal of the stay application by the second respondent. However, there shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in these writ petitions shall stand closed. ___________________ T. VINOD KUMAR, J Date: 22.10.2019 Isn
