HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.32534 OF 2016 ORDER:

This writ petition is filed by the petitioner challenging the action of respondents 2 & 3 in not taking action pursuant to his petitioner dated 2.9.2016 complaining unauthorized constructions being undertaken by the respondents 4 to 6 in respect of 8746 sq.yds., situated in Sy.No.205/3 (old)/293(new), TS No.12, Ward No.21, Block No.K, Gudimalkapur village, Aasifnagar Mandal, Hyderabad.

The case of the petitioner is as follows:
The petitioner is the absolute owner of the subject-land having purchased the same along with 7 others by virtue of sale deed 18.9.1987. There is a dispute between the petitioner and respondents 4 to 6 regarding construction of a compound wall and in that regard, the dispute has been carried in writ petition No.18987 of 2011 and batch before this Court and eventually, the compound wall was demolished by the official respondents. While so, during the first week of September, 2016 the respondents 4 to 6 again made attempts to construct a compound wall. Immediately, the petitioner gave a representation dated 2.9.2016 to the 3rd respondent to take action against the unauthorized constructions being undertaken by respondents 4 to 6, but so far, no action has been taken. 3.
Heard and perused the material available on record. 4.
Today, the learned counsel appearing on behalf of respondents 4 to 6 informed this Court that the respondents 4 to 6 are not proceeding with any construction and that they have not intended to construct anything on the subject-land. The learned Standing Counsel appearing on behalf of respondents 2 & 3 submitted that they have conducted inspection as per
the directions of this Court, and no construction activity is being carried on in the said land.

Recording the submission of learned Standing Counsel for respondents 2 & 3, the writ petition is closed as no orders are necessary. However, it is left open to the petitioner to move this Court if any construction activity is taken up by respondents 4 to 6 without obtaining any permission from the respondents 2 & 3 or there is any deviation from the sanctioned plan, if any, being carried on by the respondents 4 to 6. No costs. Consequently, Miscellaneous petitions pending, if any, shall stand closed.
